Attack on 7-year-old going to grand jury

Niagara Gazette — LOCKPORT — A Niagara County grand jury will hear the case against a Lockport man accused of trying to kill a 7-year-old girl.

Lockport City Court Judge William Watson made the ruling Monday as David L. Alfonso, 28, made his first court appearance since the New Year’s Eve attack. He has been charged with attempted second-degree murder and second-degree assault. He is being held in Niagara County Jail on $1 million bail.

Police say Alfonso brutally attacked his girlfriend’s 7-year-old daughter on Dec. 31. During Monday’s preliminary felony hearing, prosecutors called a key witness in the case to testify, according to Channel 7 News.

Danielle Rubin, a tenant on Church Street in Lockport testified to hearing a loud bang on her door New Year’s Eve. Rubin said she discovered the 7-year-old girl covered in blood, missing teeth, screaming, ‘David is trying to kill me.’” Rubin claimed the child also had severe red marks around her neck and called 911 immediately.

“She was terrified, I’ve never seen a child so scared in my life,” said Rubin while on the stand, reported Channel 7. “She kept screaming and crying.”

Rubin says the victim’s grandmother lives in the upper apartment of her dwelling on Church Street in Lockport. Investigators say the girl was unable to speak due to severe damage to her jaw and she was rushed to Women and Children’s Hospital of Buffalo where she remained for several days.

The girl has been released from the hospital and reunited with her mother. Both remain in a safe location provided by police.
