A Niagara Falls man facing a violation of probation charge for testing positive for alcohol in his system had his Tuesday afternoon hearing in Niagara County Court called off because he showed up drunk.
Darrow K. Hill, 52, 2495 Woodlawn Ave., was given a probation sentence in 2007 after he pleaded guilty to a disorderly conduct charge. He’d been accused of being drunk and using obscene language in public.
When Hill arrived in court, a county probation officer gave him a breath test. The officer then told Judge Sara Sheldon Sperrazza that Hill had a blood alcohol level of 0.137 percent, significantly above the state limit for intoxication of 0.08 percent.
Sperrazza adjourned the hearing and told Hill he needed to be “stone cold sober” before it could continue. The judge also sentenced Hill to serve one day in Niagara County Jail.
