WHEATFIELD — A Niagara Falls man was charged with disorderly conduct after he became irate at a Niagara County Sheriff's deputy who was talking on a cell phone in his patrol car.
James B. Vallier, 38, 1836 Weston Ave., Niagara Falls, pulled alongside a deputy at Ward Road and Niagara Falls Boulevard at 1:28 p.m. Tuesday. The deputy was using a his cell phone and Vallier began yelling obscenities at the officer to stop.
The deputy pulled over Vallier who continued to scream obscenities, telling the deputy he'd lost a loved one in a car accident. The deputy said he was using the speaker phone function in compliance with the state's cell phone driving law, but Vallier continued to shout and when the deputy told Vallier to get out of his car he initially refused.
After exiting the car in a threatening manner, the deputy threatened to use a Taser and Vallier changed his tune, apologizing to the deputy and asking not to be arrested — to no avail. Vallier is being held in lieu of $500 bail.
