NIAGARA FALLS: Marshall assaulted while serving eviction
A Niagara Falls city marshall was assaulted late Tuesday afternoon as he attempted to serve an eviction notice on a 64-year-old woman.
The marshall told Falls police he went to 1123 19th St. to serve the notice on the residents of an apartment there and walked in when he found the door open. The 71-year-old marshall said he was confronted by a woman resident, who after he identified himself, ordered him out of her home.
The woman, Patricia Tormino, told him, “I don’t care who you are, get the hell out.”
The marshall said he left the apartment and Tormino slammed the door behind him. As the marshall attempted to post the eviction notice on the apartment door, Tormino opened it and swung at him, knocking his glasses off his face.
The man said Tormino charged at him and her “took her to the ground,” where they struggled until two passers-by called police. The marshall said Tormino’s husband began yelling at him for fighting with his wide and he released her.
Police charged Tormino, 64, 1123 19th St., Apt. 3, with second-degree assault, second-degree obstructing governmental administration and two counts of fourth-degree criminal mischief.
Officers said the marshall suffered cuts and bruises to his face, but refused medical attention.
