One DWI arrest leads to another

Falls police at the scene of a DWI traffic stop early Sunday morning arrested a second person for DWI after they hit a patrol car while trying to get around it.

Officers stopped Trent A. Hamilton II, 26, 145 Green St., Apt. 3, at Main and Third streets about 1:15 a.m. for changing lanes unsafely and almost hitting another car. Hamilton appeared intoxicated, failed field sobriety tests and was eventually charged with DWI and making an unsafe lane change. His blood alcohol content was measured at 0.21 percent.

While officers were dealing with Hamilton, Deon R. Belton-Ubiles, 29, 1666 South Ave., was trying to get around the parked patrol car, which had its dome lights on, and struck its rear driver’s-side quarter panel causing minor damage to both cars.

Belton-Ubiles also appeared intoxicated and failed field sobriety tests. After being charged with DWI and no inspection she refused a breath test.



Round up of ‘posse’ leads to arrests

Falls police arrested four men early Sunday morning, including the victim of the assault they were investigating, after a group of men arrived on the scene to possibly exact a little revenge.

Officers were called to 7318 Buffalo Ave. about 3:30 a.m. after a resident there, Brian J. Bundy, 21, reported that he was jumped by four men who fled to a nearby address.

While taking the report, officers said numerous vehicles arrived at the address and about eight to 10 men got out. The men, police said, had gathered there to go after the four men who had jumped Bundy.

Officers told everyone to leave and eventually charged Bundy and three other men when they refused and became uncooperative.

Also charged were: Matthew T. Vassallo, 19, 879 Ruie Road, North Tonawanda; Michael J. Tubbs, 19, 266 Parkwood, Kenmore; and Michael N. Matheis, 22, 419 Parkhurst Blvd., Tonawanda. The four men were charged with unlawful assembly and disorderly conduct.



Niagara Falls

• CHARGED: Nicholas P. Barrett, 20, 623 Pasadena Ave., was charged with DWI, no insurance and failure to signal about 1:30 a.m. Sunday, according to Falls police. Barrett was stopped on the 8300 block of Munson Avenue and charged after failing field sobriety tests. He registered a 0.12 blood alcohol content at police headquarters, the report said.

• CHARGED: Kalid N. Abusalah, 25, 4600 Hyde Park Blvd., Apt. 27, was charged with driving without a license, second-degree aggravated unlicensed operation and other vehicle infractions about 8:45 p.m. Saturday, according to Falls police. Abusalah was charged after he tried to drive his ’01 Cadillac after switching the license plates with his wife’s car. Police said Abusalah was also wanted on a warrant.

• CHARGED: Bejamin K. Butler, 29, 605 Chasm Ave., Apt. 3, was charged with disorderly conduct a little after midnight on Sunday, according to police. Called to Butler’s apartment for a complaint of a loud stereo, officers said Butler actually turned up the volume when he saw police arrive and was loud and belligerent.

• CHARGED: Two women who remained behind were charged after police pulled a vehicle over on Pine Avenue about 5:30 a.m. Sunday and three men inside fled the vehicle. Simone D. Evans, 18, 630 1/2 15th St., and Demiesha C. Chatmon, 18, 2114 Seneca Ave., were both charged with disorderly conduct after becoming belligerent and refusing to cooperate with police. Additionally, Chatmon was charged with possession of marijuana, the report said.

• CHARGED: Joseph A. Ferlito, 22, 2959 Weston Ave., was charged with disorderly conduct about 1:15 a.m. Sunday, according to Falls police. He was charged after police were called to the Grand Niagara Hotel, 114 Buffalo Ave., for a report of a fight.

• CAR RECOVERED: Police found a ’03 GMC Sierra that had been reported stolen from Whitney Avenue sitting in the parking lot of the Aquarium of Niagara, 701 Whirlpool St., Sunday. The owner was notified and came out to pick up the vehicle, which had a dent in the hood and steering column damage. The estimated damage was $550.

• THEFT: A 42-year-old 80th Street resident told police Sunday someone had stolen several items from his apartment including $400, valium tablets and two gold rings, sometime since June 1. The resident told officers someone using a key gained entry to the apartment. The total estimated loss is $1,200.

• VANDALISM: Staff at Pizza Hut, 7721 Niagara Falls Blvd., reported Sunday morning that sometime overnight someone had glued pieces of wood into the locks of a business and a nearby storage shed. Staff were unable to get inside the business and a locksmith was called. The report said the damage may have been done by a disgruntled worker or by people from a nearby party Saturday night. The estimated damage was $400.

Wheatfield

• CRIMINAL MISCHIEF: An Alder Creek Drive resident reported someone cut the cables on her Direct TV dish Saturday night causing $50 damage.

• RECOVERED PROPERTY: A Walmore Road resident found a front bumper of a truck in their front lawn with the license plate still attached Saturday afternoon. The license plate revealed the vehicle was involved in an accident at 4:45 a.m. Saturday on the railroad tracks off Liberty Drive.

City of Lockport

• CHARGED: Daniel K. DeCarlo, 49, 198 Pine St. was charged with failure to keep right, failure to signal, driving while intoxicated and third degree aggravated unlicensed operation. DeCarlo was observed failing to keep right on Church Street at 12:15 a.m. on Sunday. He also failed to signal and stopped at a driveway on North Transit. DeCarlo had glassy eyes, slurred speech and the odor of alcoholic beverage. He failed field sobriety tests.

• CHARGED: Jason McDermott, 33, 38 Evans St. was charged with third degree criminal mischief. A neighbor complained she was being harassed by McDermott who said that the woman speeds in their common driveway endangering his children. According to the report, McDermott admitted throwing a beer bottle at her car Saturday night at broke the rear passenger window. The victim requested an order of protection.

• CHARGED: Joseph R. Kress, 23, 48 Waterman St. Upper, was charged with two counts of third degree possession of a controlled substance. The patrol responded to Waterman Street on Saturday for the report of breaking glass. According to the report, Kress said he accidentally broke the door window with a golf club. During the investigation, the police found suspected cocaine on the coffee table and in a prescription bottle hidden in the cushion of the chair. Also found was over $400 in cash and a smoking pipe under the sofa.

Town of Lockport

• CHARGED: Bradley J. Kunkle, 23, 7367 Transit Road, E. Amherst was charged with aggravated DWI, first-degree aggravated unlicensed operation, drinking alcohol in a motor vehicle and moving from a lane unsafely at 5 a.m. Sunday. Police executed a traffic stop on South Transit Road in the Town of Lockport. The patrol could detect a strong odor of a alcoholic beverage and observed bloodshot eyes and impaired speech. An ice cold Labatt Blue Beer bottle was in the cup holder of the vehicle. Kunkle failed all tests given by patrol and was then taken into custody at Niagara County Jail. Kunkle registered .23 percent blood alcohol content. Bail was set at $750.00 and the defendant was ordered to appear in the Town of Lockport on Tuesday.
