Tourist charged

with violating Leandra’s Law

A Pennsylvania man was charged under New York’s newly enacted Leandra’s Law, after State Park Police stopped him while he was driving drunk with a child in the back seat of his car.

Joshua Smith, 28, of Zellenople, was charged with aggravated driving while intoxicated with a child and endangering the welfare of a child.

Park police said they stopped Smith after they saw him driving erratically on Goat Island Drive on Thursday afternoon. Officers said Smith had a 3-year-old child in the back seat of his car and appeared to be intoxicated.

A Breathalyzer test later showed Smith with a blood alcohol level of 0.18 percent, more than double the legal limit in New York.



ROYALTON

Fire destroys barn

Niagara County sheriff’s investigators are still trying to determine the cause of a barn fire that broke out at 5:22 a.m. Friday at 4073 Root Road in Royalton.

A report said a resident living in a mobile home behind the barn heard a crackling noise and discovered the barn fully engulfed when the 911 call was made.

No injuries were reported., The fire left about $50,000 worth of property damage, deputies said.

Fire companies from Gasport, Middleport, Hartland and Terry’s Corners responded to the scene and extinguished the fire.



Niagara Falls

• BURGLARY: Police are investigating a burglary in the 1600 block of Pine Avenue. A 20-year-old woman told officers that between 12:30 and 2:15 p.m. Friday, someone entered her apartment and stole a 32-inch flat-screen TV and a sofa. The items were valued at $2,500, and there was no sign of forced entry.

• THEFT: Officers are looking into a theft in the 400 block of 26 street. A 67-year-old man reported that between 8 a.m. and 2:30 p.m. Friday someone stole a wheelchair from inside the front gate of his home.

• THEFT: Officers are investigating a report of missing four-wheelers that were left at a local business. A 23-year-old male told police that on Jan. 26, he quit his job at a local repair shop and when he returned to retrieve four-wheelers they were missing.

• ASSAULT: Police are investigating an assault in the Applewalk development. A 75-year-old male told police between 11 and 11:10 a.m. Friday he was approached by two males who asked for a cigarette, when the victim said he didn’t have one they punched him in face. A struggle ensued until the victim grabbed a hammer and struck one of the his assailants several times. The suspects fled the scene.

Town of Tonawanda

• DWI: Cecilio A. Maldonado was charged at 10:17 p.m. Wednesday with DWI, reckless driving, refusing a breath test and aggravated unlicensed operation of a vehicle. Maldonado was questioned as he walked up to his house because another driver saw him weaving, according to reports. The officer detected the odor of alcohol on Maldonado’s breath, but he refused to submit to any field sobriety tests. He also refused a breath test. Maldonado is being held in lieu of $850 bail.
